General Conditions of Sale

Preamble
These General Conditions of Sale govern all sales made by the company La Maison du Foie Gras (La Dommoise), whose head office is located in Domme, to consumers, via its website or in store.

These general conditions of sale shall prevail over any other conditions appearing in any other document, unless prior, express and written derogation is given. They apply to transactions taking place on the French website www.lamaisondu-foie-gras.com.

Article 1 - Products
The products offered for sale are those listed on our website and in our physical store, subject to availability. Each product is presented with the most accurate description possible; however, photographs and descriptions are not contractually binding.

The offers visible on the site are valid while they are online, and while stocks last, for any purchase made online in mainland France and Corsica unless otherwise stated.

Article 2 - Price
Prices are listed in euros, inclusive of all taxes (TTC), excluding delivery charges. La Dommoise reserves the right to change its prices at any time; however, the product will be billed based on the price in effect at the time the order is validated.

Article 3 - Order
Any validated order implies an obligation to pay. La Dommoise reserves the right to refuse an order for legitimate reasons.

Article 4 - Payment
Payment is made by credit card via a secure system, bank transfer, or cash (in-store only). The debit is made at the time of order validation.

Article 5 - Delivery

La Dommoise uses DPD to deliver its products. Orders are shipped within a maximum of 5 business days of receiving payment. Average delivery times by DPD are generally 24 to 72 business hours from shipment, depending on the destination. Once the order is shipped, the customer receives a tracking number allowing them to track their package in real time via the DPD carrier's website. La Dommoise cannot be held responsible for delays or incidents related to the carrier.

Article 6 - Right of withdrawal
In accordance with current legislation, the customer has 14 days from receipt of their order to exercise their right of withdrawal, with the exception of perishable products (fresh foie gras, opened preserves, sensitive food products).

Article 7 - Guarantees
La Dommoise guarantees the quality and conformity of its products. In the event of a defective product, La Dommoise undertakes to replace the product in question or to provide a refund upon return of the defective product, subject to validation by our services.

Article 8 - Protection of personal data
The personal data collected during your order is used exclusively for order management and customer relations. You have the right to access, rectify, and delete your data.

Article 9 - Intellectual property
All content on the website and in the store (texts, images, logos, etc.) is the exclusive property of La Dommoise. Any reproduction without prior authorization is strictly prohibited.

Article 10 - Use of personal information

In accordance with the French Data Protection Act, the processing of personal information relating to users has been declared to the French National Commission for Data Protection and Liberties (CNIL). The user has (Article 34 of Law 78-17 of 6 January 1978) a right to access, modify, rectify and delete data concerning him/her, which he/she may exercise in writing to La Dommoise or by email at lamaisondufoiegras@orange.fr . La Dommoise undertakes not to disclose its customers' contact details to a third party.

Article 11 - Applicable law and competent jurisdiction
These general terms and conditions are subject to French law. In the event of a dispute, the competent court will be that of the location of La Dommoise's registered office.
